Artificial intelligence is no longer relegated to science fiction or experimental laboratories. It is ingrained in everyday life, through recommendation systems that choose whom you will listen to, chatbots dealing with customer requests, and ads that seem to predict your private conversations. For much of the last decade, this has felt like the digital Wild West—something massively powerful and innovative that was unregulated.
The constant question has been: Is any of this being regulated? In a big step towards regulation, the European Union has launched the first full regulatory framework called the EU AI Act. Phased in as of 2025, the EU AI Act will systematically begin to shift how artificial intelligence is designed, created, and tracked. This law not only applies to companies in Europe but, essentially, it is for companies everywhere, anytime they try to sell their products or services in European markets, and anything artificial intelligence-based, it is a law that governs the development and/or use of artificial intelligence (AI) in the European Union (EU).
The Act is a new rulebook for one of the biggest changes associated with using technology for the century. It should not be seen as a thick legal document.
What is the EU AI Act?
The EU AI Act operates similarly to a product safety framework for domestic appliances. A household appliance that poses an unreasonable risk cannot be sold (i.e., cannot sell the toaster that might electrocute you), and likewise, AI systems must meet a minimum standard for safety and requirements on transparency and accountability.
For example, an AI model for screening job applicants, even if it unintentionally excludes candidates from a certain university or academic background, can have significant consequences, even if there is no tangible harm. Likewise, many diagnostic AI tools can affect patient management if not properly tested.
The legislation also firmly puts AI in the public domain as not something that’s particularly mysterious or above examination. It is a product, and like any product, we regulate the product based on the level of risk that it has. Evidently, the Act means to use the guiding principle of what’s reasonable: the higher the level of risk that an AI system typically poses, the stricter the regulations governing its use.

The year 2025 stands as the crucial inflection point in the development of artificial intelligence legislation. So far, largely circling around the rhetoric of policy discussion, we are now entering the stage of tangible obligations. Starting in 2025, there will be actual legal and compliance obligations for those developing AI or using AI applications in the EU. Why Did Europe Do This?
Europe did not select AI regulation by happenstance or coincidence. It was driven primarily by enormous public concern and countless publicly documented abuses.

- AI recruitment systems with an inbuilt disadvantage to female candidates,
- Facial recognition models making false matches to individuals is exceedingly disproportionate for people of color.
- Content algorithms on social media platforms that amplifed harmful or extremist material.

Regulations to protect the workplace, consumer products, or digital services were unable to account for the complexities of autonomous decision-making technology. 4. Minimal Risk:

Examples: Email spam filters, video game AI, recommendation engines for entertainment platforms.
The philosophy is clear: regulation must be proportionate. A simple translation tool does not warrant the same scrutiny as an AI model approving medical treatment.
Explicit Prohibitions
While much of the Act revolves around compliance obligations for businesses and developers, it also includes explicit prohibitions of AI applications that are expressly incompatible with European values, human rights, and democratic values. These prohibitions seek to establish barriers to misuse, exploitation, and harm facilitated by artificial intelligence systems. Some of the most significant prohibitions include:
1. Predictive Policing:
The Act expressly prohibits any AI system that seeks to predict the criminal activity of an individual based on their personal data, behavior patterns, or predictive algorithms. Real-life evidence suggests that predictive policing algorithms have exhibited bias.
For example, the COMPAS algorithm used in U.S. courts to predict recidivism showed racial discrimination against black defendants disproportionately flagged as being at high risk. The Act strives to eliminate these biases and disproportionate outcomes and states that AI cannot replace human judgment in legal matters and that individuals cannot be punished for what they have not done based on a machine’s predictive analysis.
2. Emotion Recognition in Employment or Education:

Some companies piloted AI systems that sought to track employee attention and even try to predict burnout, violating individual privacy and consent rights. Government-sponsored AI systems that rank a person’s fidelity, behavior, or online activity are banned under the Act. A Chinese social credit system, where citizens’ score affects their access to services, is the type of social scoring system the EU hopes to prohibit. The regulators are clear on one area: “if it isn’t written down, it didn’t happen,”. Business will need to start documenting their AI usage, including sources of data, and what testing, if any, was completed as part of the decision process.
At least for Companies that operate on a multi-national basis, internal governance systems that are EU-based will also keep them ahead of parallel regulatory risks in other countries.
The Bigger Picture
The aim of the EU AI Act is not to stop progress but to ensure its responsible, trustworthy, and rights-respecting nature. The purpose of the Act is to facilitate innovation for the public good whilst also blocking exploitation and systematic harm.
The EU is prepared to drive up trust in artificial intelligence by providing clarity and enforceability. Citizens need to be able to trust that AI systems, which might impact their health, finances, or future opportunities, are safe and accountable. For businesses, compliance may feel burdensome at the outset, but it will, in the long term, ensure a level playing field and foster adoption by relieving uncertainty.
The Act also has global ramifications. Similar to how GDPR reshaped the digital privacy space far beyond the borders of Europe, the AI Act will no doubt affect regulators in North America, Asia, and elsewhere. For instance, global companies likely will not create entirely separate products for Europe, so the EU will mostly establish international standards that will gradually become default standards outside of Europe.
